Agree to the following:

The mare will be sired by the Appaloosa Stallion Top Quest Zeuss registration number 567360.

The terms and conditions detailed below are part of this contract. These need to be signed and dated by the mare’s owner.

At delivery of the mare the following will be made available to the stallion owner:

1. Original Pedigree ApHC, photocopy of both sides

2. Swab, not older than 3 weeks

3. Vaccination records of the mare including vaccination for the abortion virus

4. Equidenpass

The horse shoes of the mare’s back hooves will have been removed prior to arrival.

The owner of the stallion gives a “Live-Foal-Guarantee”, although she will not be responsible for the success of the mating. The post mating can be taken up in the following year.

The covering fee of 600 Euros (reduced to 400 Euros for Rom, NRHA Money earning and / or 1A Praemien mares) is to be paid before the first mating. The stabling fee for the mare is 12 Euros per day; if she is with foal there is an additional fee of 5 Euros per day.

Terms and conditions:

• The mare will only be accepted if she is halter trained.

• The stallion owner gives a “Live-Foal-Guarantee”. In the case the mare is not impregnated, reabsorbs, aborts or gives birth to a dead foal, the mare can be mated free of charge the following year. The stabling fees are nevertheless at the expense of the mare’s owner. If a Vet appointed by the stallion owner diagnoses breeding unsuitability of the mare, this will render the “Live-Foal-Guarantee” null and void.

• No colors or pattern guaranties are given.

• Proof of a valid swap no older than 3 weeks has to be provided for each mare. In case the stallion owner has doubts, she can initiate another swap test at the cost of the mare’s owner. In case of virus abortion within the last 12 month in the country of origin, the mare will not be accepted nor mated. If the mare’s owner withholds such information, he will be liable for any damage.

• No liability for accidents during mating is accepted.

• Mares that cannot be covered without danger for the stallion or the cover personnel will after discussions with the mare’s owner be returned without coverage. In this case only the stabling fees apply. The cover fees will be refunded.

• In the case of the mare becoming ill while on the premises the stallion owner is permitted to call in a vet of his choice and at the cost of the mare’s owner. The mare’s owner is to be informed.

• The mare’s owner is by law liable for any actions of his mare and has been advised to take up liability insurance. The mare’s owner releases the stallion owner of any possible liability for third party damage or injury and releases the stallion owner of any liability for the mare and foal.

• The covering fee is due before the first mating. The stabling costs and any vet fees before the mare is returned to her owner.

• Any verbal statement / agreements are null and void. Jurisdiction is in any case Kusel.
